Terms and Conditions Photography Holiday

1 – A non-refundable deposit of £100 per person is required at the time of booking and must be sent with the completed booking form.

2 – The balance of the holiday price is due 8 weeks prior to the departure date. If this last payment does not reach us by the date specified, Philip Dunn reserves the right to treat the booking as cancelled and retain the deposit.

3 – If a holiday booking is made 8 weeks or less before the departure date the full amount is payable at the time of booking.

4 – Receipt of a deposit does not imply acceptance of a booking. Philip Dunn will confirm acceptance of your booking in writing.

5 – Cancellation must be made in writing. The date the letter is received by us before departure date determines the cancellation charges applicable. These charges are expressed as a percentage of the total tour price, and are as follows:

  • More than 28 days: 50%
  • 28 to 15 days: 70%
  • 15 days or less before departure 100%

If the cancellation is covered under the terms of your insurance policy you may be able to reclaim these charges.

6 – The very nature of the photography holiday offered requires flexibility by all parties and must allow for alternatives because of weather/local conditions etc. For this reason the outline itinerary and holiday description must be taken as an indication of what may take place on the holiday, and not as a contractual obligation.

7 – In the unlikely event that Philip Dunn is unable to attend due to illness or other circumstances beyond his control, Philip Dunn will first try to find an suitably qualified replacement tutor/leader. If this proves impossible, the holiday may be cancelled and all money paid to Philip Dunn will be reimbursed.

8 – If a photography holiday is cancelled for reasons stated in No7, Philip Dunn can not accept responsibility for any consequential loss to you however that loss is incurred.

9 – Philip Dunn reserves the right to change any of the prices, service or other particulars contained on the Photoactive website at any time. If this happens he will inform you immediately and give you the opportunity to cancel any contract between you and him.

10 – Where airport/hotel transfers are part of the cost of the holiday, such transfers are only included when participants travel on the flights agreed previously by Philip Dunn. If you arrive or depart on different flights you will be responsible for your own transfer costs and arrangements. If you arrive or depart on dates other than those specified for the start and finish of the holiday, transfers will not be included except by prior arrangement with Philip Dunn.

11 Philip Dunn does not accept liability for any loss or additional expense caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness or force majeure. Such losses or additional expenses are the responsibility of the passenger. Force majeure represents unusual and unforeseeable circumstances such as war or the threat of war, riots, terrorist activity, civil strife, industrial disputes, natural or nuclear disaster, fire, flood or adverse weather conditions.

12 – All participants must be physically and mentally fit for the proposed activities before arrival. If you have any doubts about this, please ask beforehand. Any medical conditions that may affect the running of the holiday should be mentioned on the booking form. Some holidays may not be suitable for people with certain medical conditions.

13 – The very nature of a photography holidays means you will be visiting a wide variety of outdoor and indoor locations. Some of these may entail an element of risk and, whilst every possible effort is made to ensure your safety, it is up to you to use your own judgement and sense in order to ensure your personal safety.

14 – All clients must sign a disclaim form stating that they take responsibility for their own personal actions and risk during the holiday.

15 Philip Dunn does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form. Any claims shall be subject to Scottish law in respect of any question of liability or quantum. 16 – Your own insurance policy must cover the eventuality of accident/illness/death and any repatriation costs.

17 – Philip Dunn reserves the right to change or cancel a holiday if the required minimum number of six students is not reached. If the minimum number of bookings required to run a course is not met, and if Philip Dunn has to cancel a course for this reason, he will not do so less than 30 days prior to departure. If a holiday is cancelled for this reason all money paid to Philip Dunn, including your deposit, will be refunded, otherwise the deposit is non-refundable. Refunds payments will be limited to the total amounts paid to Philip Dunn. Philip Dunn can not be liable for any consequential loss of any kind however that loss is incurred.

18 – For the benefit and protection of the client,  and in compliance with the Package Tours Regulations 1992, Philip Dunn has deposited a Reserve Fund in a Bonded Account with Lloyds Bank. This Bonded Reserve Fund is guaranteed by Letter and Reference from Lloyds that it is more than sufficient to repay any monies paid to him by clients booked on his holidays. In the highly unlikely event that he should suffer financial difficulties, this bonded Fund will be made available for the purpose of repaying those creditors

19 – You must communicate any perceived failure in the performance of this contract at the time to us and give us the opportunity to arrive at a satisfactory solution.

20 – It is a term of the contract between us that you will obtain full and appropriate and full travel insurance cover before you set out on the holiday. The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the holiday (whether in whole or in part), personal accident, death and injury, medical and repatriation costs (for overseas holidays), loss of baggage and personal money and effects and flight cancellations and delays. It is a condition of booking that all travellers are covered by this comprehensive travel insurance and do not travel against medical advice. We cannot be responsible for costs you incur as a result of failing to take out insurance suitable for your needs. You are responsible for indemnifying us in full in the event that we incur any losses or expenses arising out of your failure to take out adequate insurance cover.

21 – You must be prepared to show proof of your insurance cover at the time of paying the balance for your holiday/course. Philip Dunn will require:

  • Name of Insurance Company
  • Insurance Policy Number
  • Insurance Emergency or Hotline telephone number

22 – All clients must be in possession of a valid passport and all visas, permits and certificates, including medical certificates required for the whole of the journey and the client accepts responsibility for obtaining the same. In order to get reciprocal health care in EU, you need a valid EHIC card. For full details visit www.dh.gov.uk/travellers or phone 0845 606 2030. All information and advice given by Philip Dunn is given in good faith.

23 – Philip Dunn may take photographs of the clients enjoying any or all the activities during the holidays. These photographs may be used for publicity purposes and/or on the PhotoActive and the Inspiration Holidays websites. These photographs are often shared with the you for everyone's pleasure.

24 – By signing (or submitting the booking form online), you are agreeing to accept all these conditions. The person who signs the booking form does so on behalf of all the individuals included on it, so that all are bound by the booking conditions.
